1. Introduction and acceptance of terms

Welcome to Hit the Road Dude AI, operated by Wang Wei (王维), an individual operating under the laws of the People's Republic of China ("Hit the Road Dude AI", "we", "us", "our").

These Terms of Service ("Terms") govern your access to and use of our AI-powered video service, which turns one photo into a short video of the "Hit the Road Dude" meme, available at https://hittheroaddude.fun (the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy, Acceptable Use Policy and Refund Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

Important: if you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Service description

2.1 What we provide

Hit the Road Dude AI provides an AI-powered web service that lets users upload one photo (of their pet, of themselves, or of a person who has given explicit permission) and receive a 10-second vertical AI video in which the subject sits behind the wheel of a pickup truck and speaks the lines of the "Hit the Road Dude" meme. The Service is a digital software-as-a-service product delivered via the internet. Each video is generated from a fixed template written by us; users do not write prompts.

2.2 Nature of the Service

The Service is a digital, intangible product. Upon confirmed payment, credits are added to your balance immediately and can be used to generate videos straight away. Due to the immediate digital delivery, specific limitations apply to refunds, as described in Section 7.

2.3 AI model dependency

The Service uses the third-party AI video model Grok Imagine Video 1.5 Lite by xAI, accessed through fal.ai, and fal.ai's image-safety classifier for content moderation. The model is named on the generator before you generate. Service performance and availability may be affected by the operational status of these providers. We will try to communicate significant disruptions in a timely manner.

3. Account registration and eligibility

3.1 Account creation and guest use

You can buy credits and generate videos as a guest, without creating an account. Guest credits and videos are tied to the browser you used; guest videos are available to download for 3 days. If you create an account, you must provide accurate and complete information. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security

  • Notify us immediately of any unauthorized use at support@hittheroaddude.fun.
  • Do not share your credentials with any third party.
  • Keep your billing email address up to date.

3.3 Business accounts

If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Credits and credit packs

The Service operates on a credit-based system. Users may purchase one-time credit packs at any time. Credits are used to generate videos: a standard (720p) video uses 30 credits and an HD (1080p) video uses 90 credits; the cost is shown before you generate. For the available credit packs and current prices, see the pricing page. There are no subscriptions.

5. Billing and payment

5.1 Single purchase authorization

Each credit purchase is a one-time transaction. By completing a purchase, you authorize Hit the Road Dude AI to charge your payment method for the amount displayed at checkout. The Service does not offer automatic top-up and never charges you automatically.

5.2 Payment processor

Payments are processed by Waffo Pancake, our payment processor and merchant of record, which handles the payment, the receipt and applicable taxes. Payment card data is processed by Waffo Pancake and is never stored on our servers. The receipt is sent to the email you enter at checkout.

5.3 Taxes

Prices are shown in US dollars and include applicable taxes unless the checkout page says otherwise. Where required by law, applicable taxes are collected at checkout.

6. Credits validity and account termination

6.1 Credits validity

Purchased credits are valid for 12 months from the date of purchase, unless otherwise stated at the time of purchase. Credits are not transferable, cannot be exchanged for cash, and can only be used on this Service.

6.2 Termination of account

If your account is terminated (by you or by us), unused credits are retained for 30 days following termination. After this period, unused credits expire without refund, unless otherwise required by applicable law or stated in Section 13.

7. Refund policy

All credit purchases are generally non-refundable after the credits have been used. The following exceptions apply:

  • Unused credits within 14 days of purchase: a full refund may be requested within 14 days of purchase if none of the pack's credits have been used.
  • Failed or blocked generations: if a generation fails or is refused by a safety filter, its credits are returned to your balance automatically.
  • Clearly broken results: if a delivered video is blank, cut off, or does not show your subject at all, contact us within 7 days and we will return the credits or refund the payment.
  • Duplicate charge: full refund for any billing error.
  • Statutory rights (EU/UK/AU and elsewhere): any statutory withdrawal or refund right is preserved; where the law allows, the 14-day withdrawal right for digital content ends once you start using the credits.

To request a refund, write to support@hittheroaddude.fun with your checkout email and order number. We acknowledge requests within 2 business days. Approved refunds are paid back to the original payment method through Waffo Pancake, usually within 5 to 10 business days. Details: Refund Policy.

8. Billing disputes

If you believe there is an error in a charge, please contact us at support@hittheroaddude.fun before disputing it with your bank. We commit to responding within 2 business days and to resolving confirmed billing errors within 5 business days. Your card statement shows the billing descriptor set by Waffo Pancake for our store.

9. AI output and intellectual property

9.1 Ownership of outputs

Subject to these Terms and the terms of the AI model provider, the videos generated from your photo ("Outputs") are owned by you. You may use Outputs for any lawful purpose consistent with Section 10. If you share an Output, do not present it as real, unedited footage.

9.2 Input license

By uploading a photo ("Input"), you grant Hit the Road Dude AI a limited, non-exclusive license to process it solely to check it for safety and deliver the Service. We do not use your Inputs or Outputs to train AI models.

9.3 Third-party AI model dependency

Outputs are generated by Grok Imagine Video 1.5 Lite (xAI) through fal.ai and may be influenced by that model. We do not guarantee a specific output quality and accept no liability for outputs generated by third-party models beyond the refunds described in Section 7. We are not affiliated with or endorsed by xAI or fal.ai.

9.4 Accuracy of AI outputs

AI-generated content varies between runs and may not match the photo or the template exactly. You are responsible for reviewing Outputs before using or sharing them.

9.5 The template

The "Hit the Road Dude" template is inspired by a public internet meme. It does not include the original footage, audio, or the likeness of the person in it; the lines are spoken in a new synthetic voice. We claim no rights in the original meme.

10. Acceptable use policy

10.1 Permitted uses

You may use the Service only for lawful purposes in accordance with these Terms and our Acceptable Use Policy.

10.2 Photos you may upload

You may only upload photos of your own pet, of yourself, or of a person who has given you explicit permission to use their photo for this purpose. You must not upload photos of anyone else without their consent, photos of children, or photos of celebrities, public figures or politicians.

10.3 Prohibited uses

You agree NOT to use the Service to generate, or attempt to generate, any of the following:

  • Pornography or sexual (NSFW) content, including nudity.
  • Violence or gore.
  • Hate speech or content that harasses or demeans people.
  • Child-unsafe content, including any content that sexualizes minors (CSAM) or violates child protection laws.
  • Deepfakes or impersonation: content that replaces one real person's face or identity with another's, places a real person who has not consented into the video, or is intended to deceive viewers about its origin or authenticity.
  • Copyright or trademark infringement, including photos you do not have the rights to.

You also agree NOT to: circumvent or interfere with our safety checks or other security features; produce malware or phishing content; infringe anyone's intellectual property or privacy rights; resell or sub-license access to the Service without prior written approval; or violate any applicable law, regulation or card network rule.

10.4 AI-specific prohibitions

You agree NOT to use Service inputs, outputs or any derivative of them to train, fine-tune, benchmark, distil or otherwise develop any AI or machine-learning model that competes with the Service, or to systematically scrape or harvest outputs at scale.

10.5 Moderation and enforcement

Every photo is checked by an automated image-safety classifier before generation, and the AI model runs its provider's safety filter. We review every report a person sends us. If you break these rules we may block the request, delete the content, forfeit the credits used, and suspend or close your account; where the law requires it, we report illegal content to the authorities. 11. Data, privacy and security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS certified payment processor (Waffo Pancake) and is not stored on our servers. Account data is retained for 90 days following account deletion, then deleted, except where the law requires us to keep it longer.

12. Disclaimers and limitation of liability

12.1 Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS.

12.2 AI-generated content disclaimer

Outputs are AI-generated entertainment videos. They are not real footage and must not be presented as real events.

12.3 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIT THE ROAD DUDE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits rights you have under consumer protection law.

13. Term and termination

These Terms remain in effect while you use the Service. We may suspend or terminate your account if you materially breach these Terms or the Acceptable Use Policy, if we suspect fraudulent activity, or as required by law. If we terminate your account for reasons other than your breach, we will refund your unused purchased credits. You may delete your account at any time by contacting support@hittheroaddude.fun.

14. Governing law and dispute resolution

These Terms are governed by the laws of the People's Republic of China. Before starting any formal proceedings, please contact us at support@hittheroaddude.fun so we can try to resolve the issue informally. This does not affect your right to use the courts or the consumer protection rules of the country where you live.

15. General provisions

We may update these Terms at any time. Material changes will be announced on the site and, where we have your email, by email at least 14 days before they take effect. Continued use constitutes acceptance. If any provision is found unenforceable, the remainder continues in full effect.
